Synthetic drugs are illegal in Florida. The law is simple: if it is synthetic, it is illegal. You cannot buy synthetic drugs, sell them or ingest them. If you do so, you are committing a minimum of a misdemeanor and possibly a felony.

Some of these synthetic drugs were marketed as Spice, K-2, bath salts or potpourri. Now it is against the law to purchase, be in possession of or use any synthetic drug. Taking a plea or being found guilty in connection with synthetic drugs is going to result in 16 points on a criminal score sheet if it is your primary offense.
Sentencing for Synthetic Drug Convictions
A conviction for less than three grams of a synthetic drug is a misdemeanor and carries the following penalties:
– Up to a year in prison
– Up to one year of probation or community control
– A fine not to exceed $1,000
– A substance abuse evaluation, treatment, and screening
A conviction for more than three grams of a synthetic drug is a felony punishable by:
– Up to five years imprisonment
– Up to five years of supervised probation or community control
– A fine not to exceed $5,000
– A substance abuse evaluation, treatment and screening
Driver’s License Suspension
Whether you are found guilty of a misdemeanor or felony involving a synthetic drug, you are also looking at a mandatory two year driver’s license suspension. The legislature has made it mandatory for your judge to order the Secretary of State to suspend your license, whether or not you may have mitigating evidence.
